This Terms and Conditions document constitutes the regulations referred to in Article 8 of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended) and also regulates the conditions for concluding sales agreements on the Service, in accordance with other relevant laws.

The Service is operated by the company EBI – MARKETING Natalia Kostrzewa, NIP: 5532464062, REGON: 243695206, Bielsko-Biała, ul. Gościnna 92 a, 43-316, Bielsko-Biała.

The Service operates in compliance with applicable legal regulations and with respect for good business practices, particularly considering e-commerce standards regarding product quality and transaction services.

Definitions:

  • Terms and Conditions – this document along with its attachments, specifying the obligations and rights of the parties to the agreement.
  • Party – refers to either the Client or the Seller; when referring to both, it is understood as the Client and Seller collectively.
  • Distance Agreement – an agreement concluded with the Client within an organized system for concluding remote agreements, without the simultaneous physical presence of the Parties, exclusively using one or more means of remote communication until the agreement is concluded.
  • Service – the online store available at: nataliakostrzewa.pl
  • Seller – the online store available at: nataliakostrzewa.pl/shop
  • Client – a natural person, legal entity, or organizational unit without legal personality, granted legal capacity by law, purchasing products or services via the Service.
  • Consumer – a natural person purchasing products or services via the Service for purposes not directly related to their business or professional activities.
  • User – any entity using the Service.
  • Account – a User panel available immediately after payment is registered. The panel is accessible after logging in with a password sent to the provided email address.
  • Payment Method – the payment option for the ordered product or service selected by the Client during the order process, offered by the Service or as a result of individual arrangements with the Service in a manner other than those presented on the website.

§1 General Provisions

The purpose of the Service is to sell e-books, courses, and training and development materials.

In matters not regulated by these Terms and Conditions, the applicable laws of the Republic of Poland shall apply, particularly:

  • The Civil Code of April 23, 1964 (Journal of Laws No. 16, item 93, as amended),
  • The Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827),
  • The Personal Data Protection Act of August 29, 1997 (consolidated text: Journal of Laws of 2002, No. 101, item 926, as amended).

The content of the Service describing the training and services offered by the Provider does not constitute a commercial offer under the Civil Code.

The price list on the main page of the Service does not constitute a commercial offer under the Civil Code.

§2 Order Placement Procedure and Conclusion of Agreement

  • Clients may place orders via the Service 24/7 through nataliakostrzewa.pl/shop.
  • The Service sells within Poland and internationally.
  • Information about products and services presented on the Service’s website constitutes commercial information under the Civil Code.
  • Placing an order constitutes an offer under the Civil Code submitted by the Client to the Seller.
  • To place an order, the Client must use the e-shop available at nataliakostrzewa.pl/shop.
  • Upon correctly placing an order, it is deemed submitted. Orders placed in the above manner are confirmed by email. The contract is considered concluded upon sending the confirmation of order acceptance to the Client. Once the funds are registered, a direct download link for purchased e-books and online courses is immediately sent to the email provided in the form.
  • The contract is considered executed on the day the Client receives an email with access data to the ordered e-books or online courses.

§3 Payments

  • All prices presented on the Service are gross prices, expressed in Polish zloty (PLN), including VAT as specified by applicable laws.
  • The Service provides the following payment methods: a) Online payment via Tpay, b) Bank transfer, c) PayPal.
  • The Client places an order based on the prices valid at the time of placing the order.
  • The Service reserves the right to change prices. This provision does not apply to orders already being processed.

§4 Complaint Procedure

  • Any complaints related to services provided via the Service and any inquiries regarding the use of the Service should be submitted via email to: contact@ebimarketing.online.
  • A correctly submitted complaint should include at least the Client’s identification details (name, surname, address, email, contact phone number) and a description of the issue or service being complained about.
  • If the data in the complaint needs supplementation, the Service Provider will request the complainant to provide additional information before considering the complaint. The time taken to provide further clarifications extends the complaint resolution period.
  • For agreements concluded with Consumers, the Service is liable to the Consumer under the terms specified in Article 556 and subsequent articles of the Civil Code for physical or legal defects (warranty).
  • The Service will respond to the Consumer’s complaint within 14 (fourteen) days. If the Service Provider does not respond within this period, it is assumed that the complaint or Consumer’s request is justified.

§5 Withdrawal from the Agreement and Termination of Use

  • A Consumer who has concluded a distance contract has the right to withdraw from it within 14 days without giving any reason and without incurring costs, except for those specified in Articles 33, 34, and 35 of the Consumer Rights Act.
  • The withdrawal statement can be sent electronically or by mail.
  • The User may terminate their use of the Service at any time.
  • The Seller reserves the right to suspend, modify, or terminate the Service at any time for any reason.

§6 Technical Requirements and Cookies Information

  • Recommended technical requirements include a computer with internet access, access to email, and a web browser.
  • The Service uses cookies, which are small text files stored on the User’s device.
  • Users can change cookie settings in their browser settings.

§7 Final Provisions

  • The Provider reserves the right to modify the content in the Service and the price list for digital products, training, and services due to market rate changes.
  • The Provider is not responsible for damages caused by Users violating third-party rights while using the Service.
  • Any disputes between the Seller and the Consumer shall be resolved by the competent common court according to the Civil Procedure Code.
  • Any disputes between the Seller and Clients who are not Consumers shall be resolved by the court competent for the Service’s registered office.
  • The Terms and Conditions are effective from March 9, 2020.
  • In the event of a dispute, the Consumer may seek alternative dispute resolution methods, such as mediation or arbitration.
